Terms and Conditions

1. Definitions

In these Terms and Conditions, unless the context requires otherwise:

"Company" refers to Café & Deli Wholesale.

"Customer" refers to the person, business, or organisation placing an order with the Company.

"Products" refers to the goods supplied by the Company under these Terms and Conditions.

2. Orders and Specifications

2.1 All orders are subject to acceptance by the Company.

2.2 The Customer is responsible for ensuring the accuracy of all order details provided.

2.3 The Company reserves the right to amend product specifications where necessary to comply with statutory, food safety, or health and safety requirements.

3. Prices and Payment

3.1 Prices for Products are as stated in the Company’s price list, website, or official quotation.

3.2 All prices are exclusive of VAT unless otherwise specified.

3.3 Payment terms are as agreed at the point of order.

3.4 The Company reserves the right to charge interest on overdue invoices at 8% per annum above the Bank of England base rate.

4. Delivery

4.1 Delivery dates are estimates only; the Company accepts no liability for delays.

4.2 Delivery will be made to the address agreed at the time of order.

4.3 Risk of loss or damage to the Products passes to the Customer upon delivery.

5. Retention of Title

5.1 Ownership of Products remains with the Company until full payment has been received.

5.2 Until title has passed, the Customer shall hold the Products as the Company’s agent and bailee.

6. Warranties and Liability

6.1 The Company warrants that Products will match their specification and be free from material defects for 6 months from delivery.

6.2 This warranty does not apply where:

6.2.1 Defects arise from fair wear and tear, negligence, improper storage, or abnormal conditions.

6.2.2 The Customer has not paid for the Products in full by the due date.

6.3 The Company’s liability shall not exceed the value of the Products supplied and excludes indirect, consequential, or financial loss.

7. Returns and Refunds

7.1 Products may only be returned with prior written authorisation from the Company.

7.2 Unless otherwise agreed, the Customer is responsible for the cost of returning Products.

7.3 The Company strives to supply high-quality goods. If you are dissatisfied, eligible Products may be returned for a full refund within 28 days of purchase via the original payment method.

7.4 For returns relating to faults or discrepancies, the Customer must follow the process below:

7.4.1 Any discrepancies or defects must be reported within 48 hours of receipt so the Company can investigate promptly.

7.4.2 Reports must include full details of the issue, the Products affected, and the date of purchase. Photographs may be requested and should be emailed to the Company when required. Goods must not be returned without prior approval, as unregistered items may not be identifiable.

7.5 If requested to return Products, items should be sent to the Company’s designated returns address. All Products must be returned in their original packaging with all components included. Customers are advised to send returns via a tracked courier service.

8. Force Majeure

The Company shall not be liable for any delay or failure to perform its obligations caused by events beyond its reasonable control, including but not limited to extreme weather, transport disruption, supply chain issues, or industrial action.

9. General

These Terms and Conditions are governed by the laws of England and Wales. Any disputes arising in relation to them shall be subject to the exclusive jurisdiction of the courts of England and Wales
